TERMS & CONDITIONS

IMPORTANT: READ CAREFULLY BEFORE PURCHASING THE EMBODIED BUSINESS RETREAT4 ELEMENTS TICKET. BY
PURCHASING YOUR TICKET, YOU ACKNOWLEDGE THAT:

• YOU HAVE READ THIS AGREEMENT,
• YOU UNDERSTAND IT, AND
• THAT YOU ACCEPT AND AGREE TO BE BOUND BY ITS TERMS.

This Agreement (“Agreement”) is a legal contract between The Social Way Ltd (“The Social Way Ltd”), and the Student (“YOU”)
WHEREAS, The Social Way Ltd is engaged in this business of marketing and client coaching services; and WHEREAS, YOU desire
to engage The Social Way Ltd to provide business coaching services to YOU in the form of Audio and/or Visual Presentations,
Seminars and periodic personal coaching and evaluation at the Event held in Cheshire from 7th - 10th November 2024 (Event Dates);
NOW, THEREFORE, the Parties agree as follows:

SECTION 1: EVENT FEES

1.1. Event: Under the terms of this Agreement, The Social Way Ltd agrees to provide business coaching services to YOU in the form
of Audio and/or Visual Presentations, Seminars and periodic personal coaching and evaluation at the Embodied
Business Retreat 4 Elements Event held in Cheshire: (“Event”) in exchange for an Event Fee. Event Fees will be determined according
to paragraph 1.2. below. Your access to such Events is made conditional on payment of such Event Fee. Provided payment is made
– you will have access to the course material throughout the Event.

1.1.2. Term: The Term of this Agreement will commence upon YOUR acceptance of this Agreement and payment of the applicable
Event Fee. YOU agree and understand that upon commencement of the Term of this Agreement, you will be eligible to attend the
Event.

1.2. Event Fees: By accepting the terms of this Agreement, YOU agree and understand that you are committing to pay The Social
Way LTD, a total sum of £2,222 GBP (lump sum payment) OR eleven monthly payments of £222 GBP over a period of 11 months.

1.3.   Please note the retreat is fully refundable till 30th June 2024, after which date 50% of a refund applies till 31st August. After which date we’ll refund 25% of payment made. After 30th of September the retreat spot is not refundable. 

Retreat spot is always exchangeable where you are responsible for finding a person to take your spot. 

 

We create small intimate spaces to ensure the transformation and reserve the right to curate our participants to ensure the best possible experience. 

We would always recommend you as the participant to purchase travel insurance that is satisfactory to the level of cover you require. 

1.4. Force Majeure: The Social Way LTD may cancel the event if events or occurrences beyond their control make it illegal or
impossible for the event to take place hereunder (a “Force Majeure Event”). 

SECTION 2: EVENT INCLUSIONS

2.1 By accepting the terms of this Agreement YOU understand that by paying The Social Way LTD the Event Fee outlined in
paragraph 1.2, YOU have purchased a package that includes the items outlined in paragraph 2.2 and that any additional travel
arrangements, changes on schedule, or anything else NOT outlined in paragraph 2.2 is NOT included in your Event Fee and will
need to be covered by YOU.

2.2 Inclusions:, 3 nights Accomodation in Cheshire.
Breakfast, Lunch, Dinner during the Event Dates and access to the 4 day Embodied Business Retreat 4 Elements Event.

SECTION 3: NO WARRANTIES

3.1. Success not Guaranteed: By accepting the terms of this Agreement, YOU agree and understand that The Social Way LTD
provides Event(s) related to business coaching only and guarantees no specific results. YOU take full responsibility for YOUR own
success.

3.2. Limited Liability: In no event will The Social Way LTD be liable to YOU or any party related to you for any damages, including
damages for loss of business profits or other pecuniary loss, whether under a theory of contract, warranty, tort (including negligence)
products liability or otherwise, even if The Social Way LTD has been advised of the possibility of such damages. Limitations herein
described shall be applied to the greatest extent enforceable under applicable law.

SECTION 4: CONFIDENTIALITY

4.1. Confidentiality: Only authorized users, who have duly attained access to any Event(s) offered by The Social Way LTD by
personally agreeing to the terms of this Agreement are permitted use and participate with such Event(s). Except as expressly
authorized by this Agreement, YOU shall not provide or make available any Documentation, Video, Audio, or any login member
credentials to any third party, or use the Documentation, Video, Audio, or any login member credentials to teach any third party, or
otherwise disclose or discuss information revealed in any portion of the Event(s) for any purpose other than exercising rights
expressly granted to you by this Agreement.

4.2. Intellectual Property: YOU acknowledge that any Audio and/or Visual Presentations, Documentation, and other elements of the
seminars are the sole Intellectual Property of The Social Way LTD under United Kingdom copyright, trademark and other intellectual
property laws and international treaties. YOU further acknowledge and agree that, as between YOU and The Social Way LTD, The
Social Way LTD and its third party licensors own and shall continue to own all right, title, and interest in and to the Audio and/or
Visual Presentations, Documentation, and other elements of the seminars, including associated intellectual property rights under
copyright, trade secret, patent, or trademark laws. YOU agree that you will not record, repurpose or distribute any Intellectual
Property provided to you at this event.

SECTION 5: MISCELLANEOUS

5.1. Non transferability: The rights and obligations under this Agreement are personal to YOU. YOU may not assign or transfer any
rights or obligations under this Agreement.

5.2. Indemnification: YOU will, at your own expense, defend, indemnify, and hold The Social Way LTD, its agents, and employees
harmless from any and all claims, actions, liabilities, injuries, damages, losses, grants, costs, and expenses, including attorney fees,
arising out of or in connection with any use or attendance of the Event(s) of this Agreement.

5.3. Integration: This Agreement, along with any additional terms or policies incorporated herein by reference, represents the entire
Agreement between YOU and The Social Way LTD concerning the Event, and this Agreement supersedes and replaces any prior
proposal, representation, or understanding YOU may have had with The Social Way LTD relating to the Event, whether oral or
written.

5.4. Survival of terms: All provisions of these terms that by their nature should survive termination of this Agreement shall survive
including all limitations on liability, indemnification obligations, disclaimers, choice of law and intellectual property protections.

5.5. Amendment: The Social Way LTD reserves the right, in its sole discretion, to amend this Agreement from time to time by posting
an updated version of the Agreement at www.alekscerta.com

5.6. Severance: If any of these terms are held to be invalid, unenforceable or illegal for any reason by a competent court or tribunal,
the remaining terms will continue in full force and effect.

5.7 Minimum age: The Event is available only to adults over the age of eighteen (18) years. By entering into this Agreement, and
purchasing a ticket, you acknowledge that you are over eighteen (18) years.

5.8. Governing law: This Agreement shall be governed by and interpreted in all respects in accordance with the laws of Untited
Kingdom and each party irrevocably submits to the non-exclusive jurisdiction of the courts of United Kingdom. The venue for any
dispute shall be in England, United Kingdom.

BY CONFIRMING YOUR PAYMENT AND PURCHASING YOUR TICKET, YOU ACKNOWLEDGE THAT YOU UNDERSTAND
AND AGREE TO ALL OF THE AFOREMENTIONED TERMS, INCLUDING THOSE RELATED TO PROGRAM FEES, STRICT NO
REFUND POLICY, AND CONFIDENTIALITY.
